The sale of this pure bred American Pit Bull Terrier is made between Haynes Pit Bulls Kennel/HPBK and ( Buyer).
The above said American Pit Bull Terrier has been sold to the above mentioned Buyer for the total price of $(Amount of Puppy). Registration
papers will also be held until the balance is paid in full. The buyer understands that once a deposit is made, it is a commitment to buy said dog and
is therefore, NON-REFUNDABLE but is transferable to another available pup in the same litter, or a pup of a future litter. Buyer will forfeit deposit
and said dog may then be re-sold if not paid in full by the time the puppy is 8 weeks old or by this date (DATE).
IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE
EXPRESSED OR IMPLIED.
Seller guarantees the said dog is a purebred American Pit Bull Terrier, offspring of the previously mentioned Sire and Dam. Seller DOES NOT
guarantee the color of the said dog. This Pit Bull __ is registered (or) __ has the opportunity to be registered with The American Pit Bull Registry
(APBR). Additional registering organizations this Pit Bull __ is registered (or) __ has the opportunity to be registered with the Continental Kennel
Club (CKC). The new owner will retain the responsibility of completing all necessary registration information and paying any registration dues of
said Pit Bull, and to keep Haynes as part of the registered name with any and all registries. Fulfillment of all registrations is required for this
agreement to be considered valid.
Buyer certifies that he/she is not acting as an agent for another individual in the purchase of this dog, and will not sell this dog to any mass-
producing kennel (puppy mill) or business. When purchasing a dog from this seller, buyer agrees that the dog will not be used for any illegal
purposes that violate the 1976 Animal Welfare Act. The dog that the Buyer is purchasing will either be a pet, used for confirmation shows, weight
pulling or boar hunting (if permitted by the state that Buyer currently resides.) If there is evidence of the dog being abused or used in any illegal
activity, HPBK will repossess the dog with no financial reimbursement to the buyer. The buyer also agrees to sign over all registration certificates
to HPBK immediately. The buyer promises to keep the dog in a proper and humane manner. If problems arise in keeping or training, or the dog
becomes seriously ill, the Buyer agrees to consult Seller. At transfer, Seller guarantees this dog to be current on vaccinations and dewormings.
Puppies will have current veterinary Health Certificate if shipped by air. Puppies will be dewormed at the time of shipping. A normal deworming
and vaccination schedule should be followed as recommended by your veterinarian. An accurate Puppy Data Sheet will be provided to the buyer
from the seller. The seller will place no puppy under the age of 8 weeks old. This insures that the puppies have been properly vaccinated,
dewormed and weaned.
Adequate and responsible confinement will be provided by seller to prevent escape, harassment by, theft or possible injury to the general
community and in order to assist in the positive promotion of the Pit Bull breed and its responsible ownership. Buyer agrees to provide adequate
food, water, shelter, exercise, health care, training and socialization. Enrollment into obedience training has been recommended to help the buyer
in understanding effective means of communicating with this Pit Bull. HPBK recommends PetSmart’s 8 week Puppy training course which is
approximately $99.00. In addition to the Puppy Training course, there are higher levels of training which is highly beneficial to both this dog and
the new owner. Proper training is a key element to responsible dog ownership especially when dealing with American Pit Bull Terriers. The seller
should contact their local PetSmart for complete details and class schedules. Participation in The American Pit Bull Registry's visual tracking and
authentication program microchipping, and or tattooing has been encouraged to help insure return to owner in the event of this Pit Bull becomes
lost or stolen. Buyer agrees to provide updates to seller on the health and well being of this Pit Bull and any changes to contact information (i.e.
phone number, email address, home address, etc.).
This Pit Bull is currently on NuVet Plus vitamins and has been since the day of conception since the Dam is currently taking them. HPBK highly
recommends the use of NuVet Plus vitamins as a daily supplement and prevention to many common illnesses and conditions. A six day sample will
be given to the buyer at time of transfer. The seller has informed the buyer to purchase the first month of vitamins before the puppy arrives
home to ensure that they are received in time of the puppy’s arrival. HPBK is an authorized representative for NuVet Labs and their Order Code is
58709. NuVet can be contacted at their toll free number 1-800-474-7044 or at http://www.nuvet.com You must present this order code at the time of
purchase. Complete details of the ingredients and effectiveness are on HPBK’s web site as well as NuVet’s site. Use throughout this Pit Bull’s life
is highly recommended.
The seller asks that every so often the new owners send recent pictures and a note stating news on the dog. Seller recommends spaying and
neutering to any dog that is to be used as a pet. Spaying and neutering greatly reduces many health issues, the risk of unexpected litter while
controlling the Pit Bull population and leaving the breeding to responsible, educated breeders. Buyer agrees to not breed any intact female prior
to her third heat or two years of age, which ever comes first. This ensures the dam is full grown and mentally ready to care for her young. The
puppy’s health and development is not sacrificed if the dam is fully grown.
Buyer agrees to first consult the seller on taking back this Pit Bull before taking it to a shelter, pound, rescue, or other animal welfare organization
for turn-in with the understanding that such a return does not constitute refund in whole or part. If seller is unable to accept this Pit the owner will
do their best to re-home this Pit with a new responsible owner by using The American Pit Bull Registry's Individual Re-Home program in
coordination with reasonable advertising before opting to turn this Pit Bull into any shelter, pound, rescue or animal welfare organization. If such
a home is unable to be found in a reasonable period of time owner will do their best to locate a no-kill rescue or shelter who can accept this Pit
Bull. If a new home is found, the original buyer must provide the new owner's complete contact information. If no contact information is provided,
the original buyer is in violation of this contract and is liable for any In the interest of bettering the Pit Bull breed, owner will notify seller and all
registering organizations of life threatening or disabling disease or defects during its lifetime. Such disease or defects include but are not limited
to cancer, hip elbow or other orthopedic issues, heart or other internal organ conditions, cataracts, infertility, birthing difficulty, offspring with
birth defects, mental disorders, etc.
GUARANTEE DETAIL: This Pit Bull is guaranteed, to the original purchaser, to be free of serious infection, disease or defect for the following
period of time twelve (12) months. To validate this guarantee, this Pit Bull will be examined within 48 hours of delivery to buyer by a qualified
veterinarian. We ask that a copy of a receipt and/or documentation be sent to us for our records when requested. The buyer agrees to have
puppy examined by buyer's veterinarian, at buyer's expense, within 24 hours from date of purchase. If the veterinarian does not give puppy a
clean bill of health, buyer must notify seller immediately. Seller reserves the right to have puppy re-examined, at seller's expense. Any condition
that is minor, correctable, or a breed related minor condition, is not covered. If the condition is one which will go away, or is considered to be a
condition which puppy will likely grow out of, is not covered. If the puppy is then found not to be in good health, seller will resume possession of
the puppy if this is agreeable to both parties. Seller does not accept responsibility for contagious disease diagnosed after 24 hours of
possession. Your puppy has been tested and examined for many conditions to assure health. Heat exhaustion, stroke or dehydration and other
heat related conditions are not covered in any way. Remember that a puppy can overheat quickly and easily and may die as a result of
overheating. If during the 12 months this Pit Bull is found to be defective a replacement by one of equal or greater quality and gender will be
permitted within a period of six (6) months, or the next available breeding if longer. In returning this Pit Bull there will be required a signed
statement from a licensed veterinarian stating the breed, age, history of care, and diagnosis. Upon this proof there will be additional opportunity
to have the Pit Bull examined by a veterinarian of the sellers choosing. If a dispute arises after examination from sellers chosen veterinarian both
buyer and seller will have the opportunity to mutually choose a third party veterinarian and be present upon examination to help resolve said
dispute. Initial transport of this Pit Bull back to the seller will be at the cost of the buyer. In fact, any signs of neglect, abuse, malnutrition or any
other forms of improper care will void this guarantee. At the expense of the Buyer, a licensed veterinarian should examine this dog within 21
days of possession to validate this said Health Guarantee. (If purchased on Saturday, this requirement is extended through the following Monday.)
Seller does not give cash refunds for any reason. Refund/replacement will not be the required due to sustained injury, environmental health
exposure leading to illness, unlawful ownership, absence of proper training, heat stroke, carelessness, recklessness, neglect or abuse. Buyer
agrees to pay any and all veterinarian charges and shipping charges. The registration papers must be returned to seller before the pup will be
replaced. If agreed return is made, upon examination, seller has the right to maintain this Pit Bull in quarantine at the expense of the buyer for a
period of two weeks.
No other warranties are expressed or implied unless explained by Seller below:
Buyer releases Seller, and their estate from any and all liabilities, and/or damages by fault of this dog at the time of sale. These damages include
but are not limited to, destruction of property and/or physical damage to any animal, person or group of people. In the event that a breach occurs,
and the breaching party, after notice, fails to remedy or cooperate, then this contract may be enforced in a court of law, the prevailing party shall
then be entitled to be made whole and/or to recover for damages, costs, and attorney fees along with surrendering said dog back to Seller. This
contract is made out in duplicate; the Seller and the Buyer each receive one signed copy. The Buyer will receive the signed copy at the time of
transfer-ship.
